Buju Stanciu Obtains Suspension of Insolvency Decision for Romanian E-Commerce Entrepreneur

For a Romanian entrepreneur active in the e-commerce of medical and care products, Buju Stanciu & Asociații obtained the suspension of the decision that had opened the insolvency procedure, pending the resolution of the appeal.

In a sector where continuity means available stocks, fast deliveries and the trust of patients, families, clinics and commercial partners, a decision to open insolvency can have serious effects before the substantive dispute is clarified.

The case raises an important question for the business environment: can a company end up in insolvency when an essential part of the claim is based on contested penalties, invoiced unilaterally?

It was argued that the insolvency procedure should not be used to settle, under the pressure of time, a real commercial dispute. The appeal court ordered the suspension of the effects of the decision until the appeal is heard.

“An insolvency decision is not just a procedural matter. It can immediately affect a company’s reputation, commercial relations and ability to function. Therefore, insolvency should not be transformed into a pressure tool in a contested commercial dispute.”Marius Stanciu, Managing Partner, Buju Stanciu & Asociații

For companies, rapid reaction and procedural strategy can make the difference between a one-off difficulty and a crisis with disproportionate effects.

Ružička and Partners Law Firm of the Year 2026 in Public Procurement and Corporate Law

Ružička and Partners law firm has been honoured as the Law Firm of the Year 2026 in the categories of Public Procurement and Corporate Law, marking our fourteenth consecutive win in public procurement.

During the Law Firm of the Year 2026 gala evening, Ružička and Partners received awards in two categories. In Public Procurement, they have remained unbeaten since the competition’s inception in 2013 – fourteen years with fourteen first-place finishes. No other firm in the history of these awards has achieved such a remarkable record in any category. The second award was in Corporate Law.

Ružička and Partners’ record-breaking success in public procurement stems from their involvement in some of Slovakia’s most significant strategic projects. These include the Nitra–Banská Bystrica expressway, the new terminal at Bratislava Airport, the restoration of the Slovak National Gallery, the reconstruction of Roosevelt Hospital in Banská Bystrica, the football stadium in Košice, and the establishment of Volvo Cars and Jaguar Land Rover in Slovakia.

They support their clients throughout the entire procurement process, starting from preparing tender documentation to representing them before the Public Procurement Office, the European Commission, and the courts. In cases concerning breaches of EU law in this area, they have maintained a 100% success rate when representing Slovakia.

“The Public Procurement Act has undergone more than thirty amendments in recent years. This level of legislative instability necessitates deep expertise and the ability to navigate constantly evolving rules. Ultimately, what matters most are tangible results—a completed road, a functioning hospital, or new trains,” said Ján Azud, Head of the Public Procurement practice at Ružička and Partners.

The second award came in the Corporate Law category. For over 30 years, Ružička and Partners has been advising clients on corporate reorganizations, ownership structures, executive decision-making, and day-to-day contractual matters, compliance, and disputes.

“Major transactions attract attention, but the true operation of a company is built on everyday decisions. Even a seemingly minor legislative change can significantly impact a business,” said Dana Nemčíková, Head of our Corporate Law practice.

The Law Firm of the Year competition, organized by EPRAVO Group in cooperation with the weekly TREND, annually evaluates the quality of legal services in Slovakia. Awards in specialized categories were presented on April 21 in Bratislava.

“We have been active in the market for over 30 years and have contributed to projects with significant economic impact. We greatly appreciate this year’s double recognition, which reflects the long-term commitment and efforts of our entire team,” added Jaroslav Ružička, Managing Partner of Ružička and Partners.

JP Karsenty & Associés IP Newsletter, June 2026

The JP Karsenty & Associés Intellectual Property Newsletter, June 2026 written by Pierre Trusson, with assistance from Emilie Menez, reviews the following news.

E-Commerce: the rights holder bears the burden of proof in the event of reporting an ad on a marketplace deemed infringing

Following a report on Amazon made by the company Dinh Van against two ads deemed infringing, the seller referred the matter to the Tribunal judiciaire de Paris in order to obtain the withdrawal of the reports and to be able to sell his products again.

On this occasion, the urgent applications judge ruled on the evidence to be provided by the holder of intellectual property rights to justify the withdrawal of the disputed advertisements.

Our Focus IP reviews this judgment in detail by identifying the elements that the intellectual property right holder must keep in the perspective of a possible challenge to his report made against an advertisement deemed infringing.

Buju Stanciu & Associates Wins Appeal in Large Solar Energy Commercial Dispute

Buju Stanciu & Associates successfully assisted a major international player in the solar energy sector, headquartered in China and with its European headquarters in Germany, in a commercial dispute related to the execution of commercial reports regarding the delivery of photovoltaic equipment.

By the decision issued on May 5, 2026, the Ploiești Court of Appeal admitted the appeal filed by the client assisted by Buju Stanciu & Associates, annulled the first instance sentence and, re-examining the case, dismissed as unfounded the claim filed against the client after, in the first instance, he had been ordered to pay a considerable amount, representing the equivalent value of deliveries allegedly not made.

The solution is relevant due to the commercial value of the dispute, the international nature of the relations between the parties and the market context in which it arose: a cross-border transaction regarding photovoltaic products, affected by the heightened volatility of prices in the solar panel industry and by difficulties arising in the phased execution of orders, deliveries and payment obligations.

The Buju Stanciu & Asociații team built the defense on appeal on an integrated analysis of the commercial relationship between the parties, the contractual correspondence, the order and delivery mechanism specific to the industry, as well as the economic effects generated by the refusal to continue the execution of the commercial relationship.

“This solution confirms the importance of a defense that is not limited to the formal reading of the documents, but reconstructs the entire commercial mechanism of the transaction. In international disputes of this type, especially in volatile sectors such as renewable energy, it is essential for the court to understand the economic reality behind orders, purchases, storage, deliveries and payments. For our client, the decision eliminates a substantial financial exposure and correctly re-establishes the factual framework of the dispute,” said lawyer Vlad Mureșan, from Buju Stanciu & Asociații, who coordinated the litigation strategy.

LNI Prague 2026 – Reconnect, Exchange and Strengthen

What an incredible few days at the LNI Spring Conference 2026 in beautiful Prague.

This year’s conference brought together colleagues from across the network to explore two of the most important challenges and opportunities facing the legal profession today: the impact of artificial intelligence on legal practice and the importance of mental health and well-being in our profession.

One clear theme emerged across the two days, AI and well-being are not separate conversations. The way firms introduce AI will shape how their people experience work. Done thoughtfully, it removes the grind of repetitive tasks and gives lawyers more room for the judgment, client relationships and thinking that make the job worthwhile. Done badly, it piles on pressure and leaves people feeling  ‘overloaded’. The qualities that sustain lawyers also happen to be the qualities AI cannot replace.

Alongside the formal sessions, the conference offered valuable opportunities to reconnect, exchange ideas and strengthen relationships across the LNI network.

We enjoyed exploring the historic city of Prague with special highlights including our visit to The Senate and a dinner cruise on the Vltava. The perfect setting for both professional and personal connections.

Thank you to everyone who attended, contributed and helped make the conference such a success. We leave Prague with fresh perspectives, practical insights and stronger connections across our international legal community.

Already looking forward to the next LNI conference in October.
