The JP Karsenty & Associés Intellectual Property Newsletter, September 2026 written by Pierre Trusson, with assistance from Clément Renou, reviews the following news.
LCEN Law: The responsibility of the author of a report that has led to the unjustified blocking of a video, even in good faith.
The creators of a show reported videos published on its platform to YouTube that included a short excerpt of it, deeming this cover to be counterfeit. After obtaining their withdrawal, they sued their creator in order to obtain compensation for the damage suffered.
During the dispute, the judges ruled on the responsibility of the author of the report with a particularly developed reasoning.
They hold that the report is made at the risk and peril of its author who may be held liable if the withdrawal is ultimately deemed unfounded on the merits, even in the case of good faith.
Focus IP reviews this judgment in detail, specifying the conditions of responsibility of the author of the report and the motivation used by the Tribunal judiciaire de Paris.

E-Commerce: the rights holder bears the burden of proof in the event of reporting an ad on a marketplace deemed infringing
Following a report on Amazon made by the company Dinh Van against two ads deemed infringing, the seller referred the matter to the Tribunal judiciaire de Paris in order to obtain the withdrawal of the reports and to be able to sell his products again.
On this occasion, the urgent applications judge ruled on the evidence to be provided by the holder of intellectual property rights to justify the withdrawal of the disputed advertisements.
Our Focus IP reviews this judgment in detail by identifying the elements that the intellectual property right holder must keep in the perspective of a possible challenge to his report made against an advertisement deemed infringing.

The JP Karsenty & Associés Intellectual Property Newsletter, March 2026 written by Pierre Trusson, with assistance from Pauline Leyval, reviews the following news.
LCEN Law: The blocking of a website ordered to internet service providers by resorting to “dynamic” injunctions
In a recent order, the President of the Tribunal judiciaire de Paris, seized by the Arcom, ordered Internet Service Providers (ISPs) to block the WatchPeopleDie.tv site, which is exclusively dedicated to the dissemination of violent content and attacks on dignity.
On that occasion, it detailed the criteria for contacting ISPs directly instead of the hosts and publishers of the disputed site and specified the terms and conditions for blocking the said site.
It also used a dynamic injunction to prevent the content of the disputed site from being “replicated” as soon as it was blocked on another website (“mirror sites”).
Our Focus goes into detail on this order and identifies the criteria that must be met by a company to obtain such an injunction.
