LCEN Law: The responsibility of the author of a report that has led to the unjustified blocking of a video, even in good faith.
The creators of a show reported videos published on its platform to YouTube that included a short excerpt of it, deeming this cover to be counterfeit. After obtaining their withdrawal, they sued their creator in order to obtain compensation for the damage suffered.
During the dispute, the judges ruled on the responsibility of the author of the report with a particularly developed reasoning.
They hold that the report is made at the risk and peril of its author who may be held liable if the withdrawal is ultimately deemed unfounded on the merits, even in the case of good faith.
