Employment Law in Malta: What are the Employer’s Obligations with regards to Employee Representatives?

In Malta, employers with 50 or more employees are required to comply with the Employee (Information and Consultation) Regulations (S.L 452.96 of the Laws of Malta), which safeguard employees’ rights to be informed and consulted on key Company matters. These regulations ensure that employees, especially those not covered by a trade union, can elect representatives to voice their concerns on issues such as company performance, job security, and organisational or structural changes within the Company. In this regard, employers facilitate fair elections and the selection process of the employee representative, ensure regular consultations among the other parties, and provide timely information to the representatives. This framework essentially fosters a cooperative work environment, balancing the interests of both the employers and employees, as the weaker party in an employment relationship.
